Brian S. Hormozi

Brian Hormozi is a trial attorney who concentrates his practice on representing businesses in labor, employment and commercial matters. He has successfully litigated cases, both individually and on trial teams with senior SRC attorneys, in state and federal courts, before administrative agencies, and in arbitration forums around the country. Brian has extensive experience representing securities broker dealers in disputes involving claims for employee raiding/unfair competition, enforcement of post-employment restrictive covenants, breach of the duty of loyalty, trade secret misappropriation, retaliation and wrongful discharge, and tortious interference with contracts and business expectancies. He has defended businesses and individuals in cases involving claims of harassment, discrimination, retaliation and other violations of the ADA, ADEA, Title VII, FMLA, FLSA, Illinois Human Rights Act, National Labor Relations Act, and various other statutes, regulations and administrative rules.

Brian also counsels businesses and individuals on a wide array of employment issues including trade secrets, covenants not to compete, non-solicitation, non-use and non-disclosure agreements, incentive compensation programs, pre-hire practices, discharge and discipline, internal investigations, reductions in force, litigation management and discovery planning.

Recently, Brian has:

  • Obtained emergency injunctive relief (TROs) to protect clients’ trade secrets and confidential information, and rights under restrictive covenant contracts in courts nationwide.
  • Successfully tried several employment and contract cases in arbitration before the Financial Industry Regulatory Authority (FINRA) on behalf of a major broker-dealer client.
  • Assisted Michael B. Roche in successfully prosecuting claims for breach of a partnership agreement on behalf of former partner of a professional services firm and defending against counterclaims premised on the violation of restrictive covenants and related business tort claims. Following a protracted arbitration proceeding, the client was awarded the complete relief sought in arbitration - in excess of $430,000 and more than $158,000 in attorneys’ fees and costs. The client was awarded an additional $38,000 in attorneys’ fees and costs after the team successfully defended against a challenge to the arbitration award in Illinois state court.
  • Obtained dismissal with prejudice of all claims asserted against a consulting business against a former client based on the consulting business’ role in opening a competing enterprise.
  • Obtained summary judgment on all claims asserted against nurse referral and placement business in professional negligence and malpractice case based on the Illinois borrowed servant doctrine and principles of agency.
  • Obtained dismissal of unfair labor practice charges brought before the National Labor Relations Board on behalf of management clients relating to alleged interference with union organizing activities.
  • Assisted Michael B. Roche in successfully obtaining an arbitration award in excess of $300,000 for a disabled trust beneficiary based on claims of negligence and breach of fiduciary duty.
  • Obtained summary judgment on behalf of a commodities broker with claims against an account holder concerning margin deficits, ultimately resulting in full relief to the client and recovery of attorneys’ fees and costs incurred in prosecuting and defending claims made by account holder.
